What Constitutes Judicial Misconduct? - LegalMatch: Criminal Law

Four examples that may indicate a judge has committed judicial misconduct are:
  • Improperly discussing a case with a lawyer.
  • Placing their personal agenda before those of the parties.
  • According special treatment to relatives or friends.
  • And the most serious, accepting a bribe

Judicial misbehaviour in the court room can also break the law, examples are:

  • Ignoring legal precedents or laws.
  • Citing invalid laws or precedents (hard to catch, even for lawyers)
  • And most seriously, lying under oath (as a judge is always under oath in the courtroom).
